concerning the establishment of

THE ROMANIAN DIPLOMATIC PARTNERS ASSOCIATION

CHAPTER ICONSTITUTION, DESIGNATION, LOCATION AND DURATION OF THE ASSOCIATION

Article 1. Establishment of the Association

The Romanian Diplomatic Partners Association (named from now on "Association") is a legal person of Romanian nationality, non-profit, organized and fulfilling its activity in accordance with the Romanian law in force, as well as in accordance with the present Statute.

Article 2. Designation of the Association

The name of the association is The Romanian Diplomatic Partners Association, in accordance with the designation given by the Ministry of Justice on the date of 13th December 2006.

Article 3. The location of the Association

3.1.The location of the Association is established on strada Radna nr. 26, sector 6, Bucharest.
3.2.. The Associates can decide, in accordance with the legal provisions, as well as with the dispositions of the Constitutive Act, relevant the location of the Association can be changed to any other place in Romania, as far as the necessary legal requirements are met.
3.3.The Association can, under the decision of the General Assembly, establish affiliated associations, based on territorial criteria or relevant a designated activity, in Romania or outside of its borders, in accordance with the legal stipulations. Also, the Association can, under the decisions made by the members of the General Assembly, establish branches, in accordance with the relevant legislation.

Article 4. The Duration of the Association

The Association is considered establish and has a legal person status starting from the date on which the registration in the Register of Associations and Foundations is entered. The duration of the Association is undetermined.

CHAPTER II.THE GOAL OF THE ASSOCIATION

Article 5.The goal and the objectives of the Association

5.1.The Association is a Romanian legal person, established as a nonpolitical and non-profit association.
5.2.. The Association, in cooperation with the Ministry of Foreign Affairs of Romania, will promote the image of the diplomatic representatives and their spouses through different actions and activities, with the aim to address the difficulties and disadvantages which appear in relation with the gregarious character of the diplomatic profession, and together with the Ministry of Foreign Affairs, it will try to find solutions and to create optimal conditions for the employee´s family members in the home Ministry.
5.3.The Partners of the Romanian diplomats are be defined as follows: members of the Romanian diplomatic families, representatives of public institutions, representatives of the local and central administration, any other persons who, through their preoccupations and activities, have a relation with the goals and objectives of the Association.
5.4.. By fulfilling its goals, the Association will join, after the integration of Romania in the European Union, the international diplomatic partners’ organization of the EU countries, the European Union Foreign Affairs Spouses Association (EUFASA).
5.5. Pursuing the achievement of its goals, as determined in article 7 of the present Constitutive Act, the Association will perform the following activities:
  • a) Guidance and support concerning the system of individual pensions and by the Ministry of the Foreign Affairs social insurance contributions due by the Romanian diplomatic partners.
  • b) ) According to the activities in foreign countries (while being posted abroad), guidance and support concerning the inherent repercussions on the principal’s salary components generated by the additional allowance of the spouse, repercussions that can take one of the following forms: the revision of the limits of the social insurances limits, the reimbursement of medical expenses for diplomats´ families abroad, implications on child allowances, various problems related to the family matters and difficulties related to divorce.
  • c)Also, support concerning schooling, i.e. problems related to chosing an appropriate school, as well as support in validating studies taken abroad and scholar reinsertion in the home country, obtaining information on kindergartens, schools or other educational institutions, individual support, summer courses, support for children with special needs, establishing contacts with the Ministry of Education, related to schooling problems.
  • d)Also, support concerning the monitoring of changing work places, support in finding jobs in Romania or in other countries, by obtaining information related to the labor market, by creating and maintaining contacts with companies willing to collaborate with the Association, support with attending continues education or for professional improvement, organizing seminars on the orientation and employment strategy, promoting the adaption of by the Ministry of Foreign Affairs concerning the employment in foreign countries.
  • e)Also, support with the view to the departure for foreign posting preparations and the facilitating of employment in foreign countries.
  • f)Create and maintain contacts with varios companies, with the to their sponsorship or support in finding jobs for those members of the Association who will ask for this kind of support.


CHAPTER III. THE ORGANIZATIONAL PRINCIPE OF THE ASSOCIATION

Article 6. The organizational principles of the Association

The organizational principles of the Association are:
a. Total autonomy.
The branches, established by the Association as entities with legal personality, enjoy autonomy and can conclude, by own authority legal acts of administration and conservation, under the conditions established by the Association through the Constitutive Act of the Branch. They can conclude mandatory legal acts in the name and on behalf of the Association, only under the previous decisions of the Board of Directors of the Association.
b.Cooperation with the governmental and non-governmental institutions, both national and international,in order to achiere the proposed goal.
c.Affiliation to other non-profit organizations, with similar or identical objectives as the Association, in Romania or in foreign countries.

CHAPTER IV. THE ACTIVITIES OF THE ASSOCIATION

Article 7. The Mandate of the Association

The Association will have the following attributions:
a.To cooperate with governmental and non-governmental institutions on issues related to the objectives of the Association and to initiate activities permitted by the law, in accordance with the present Statute.
b.To initialize and organize programs related to the goals of the Association, with the participation of specialists, as well as of any other persons from Romania or from abroad. The persons who participate in the programs organized by the Association pursue their activity in accordance with the law, as voluntaries or they with payment.
c.. To cooperate with international organizations which have similar goals and objectives as the Association, for the developing of programs initiated and organized by the Association.
d. To buy, rent or dispose of goods or real estate necessary for the pursuing of activities of the Association; to sign contracts and other legal acts, to pursue all other necessary activities, connected with the principle ones, permitted by the law to fulfill the goals of the Association (including, but not limited to closing bank accounts)
e.To request and receive material assistance from interested persons and to direct and administrate funds resulted from voluntary contributions.
f. To release or receive publications or other materials that can be necessary to the achievement of the proposed goals.
